Litigation
The firm represents a variety of corporate and individual clients in both state and federal court litigation. Our work is focused primarily on business disputes, including contract, intellectual property, labor and employment relations, and real property problems. We also litigate will contests and contested accountings. We are pleased to work as local counsel in litigation pending throughout central New York. The Henson Group, Inc. v. Stacy, 66 A.D.3d 611 (1st Dept. 2009) (prevailed at trial and on appeal enforcing employer's non-competition agreement with former employee)
Kenny v. Eddygate Park Assoc. et al., 34 A.D.3d 1017 (3rd Dep't 2006) (won at trial defending a landlord’s discretionary withholding of consent to a proposed assignment of a commercial restaurant lease and prevailed on the subsequent appeal of that decision)
Wasyliw v. Smith, 18 A.D.3d 931 (3d Dep’t 2005) (Successful response to an appeal of a Family Court decision to increase child support due to a clause in the separation agreement allowing appropriate modifications in support)
Blalock v. Board of Zoning Appeals of the City of Ithaca, et al., 17 A.D.3d 583 (3d Dep’t 2005)(Successful challenge of a BZA decision regarding setback requirements and building permits)
Massena Memorial Hospital v. Civil Service Employees Association, Inc., 300 A.D. 2d 889 (3d Dep’t 2002) (Overturned arbitrator’s decision in a hiring dispute when arbitrator acted outside of his powers in relying on civil service law rather than the collective bargaining agreement)
Jelfo v. Arthur, 295 A.D. 2d 689 (3d Dep’t 2002) (Successfully argued that a parent’s relocation to a residence three hours away from former spouse’s home interfered with the former spouse’s visitation rights such that the former spouse had a right to a modification in custody rights)
Schaufler v. Mengel, Metzger, Barr & Co., 296 A.D.2d 742 (3d Dep't 2002) (Defeated defendant’s summary judgment in dispute between CPA and his former accounting firm)
Ithaca Associates Co. v. Plataniotis, 274 A.D.2d 640 (3d Dep't 2000) (Cleared cloud on title for landlord created by purported sublessee; case concluded with jury verdict awarding legal fees and punitive damages against sublessee)
