Abrupt change: no adjustment filings possible in July and until further notice of State Department.

We are sad to echo now widely available reports that the adjustment of status filing opportunity has disappeared, and perhaps never existed. Today's visa bulletin closes all EB quota categories. See http://travel.state.gov/visa/frvi/bulletin/bulletin_3263.html. CIS too has announced that it will reject all employment-based adjustment filings. See http://www.uscis.gov/portal/site/uscis. Because litigation will surely result from these government actions, some applications received in July may form part of the plaintiff class. Also on June 27th, CIS suspended premium processing of I-140’s for the month of July. Applicants with pending adjustments or consular immigrant visas ask whether the ‘unavailable’ EB numbers will delay or affect processing of their cases. The short answer is ‘yes.’ Until a new Visa Bulletin shows EB availability, no permanent resident adjustments or immigrant visa issuances may occur, and no new I-485’s or IV interviews may be accepted. USCIS requests visa allotments for adjustment of status cases only when all other case processing has been completed. While categories like EB-1, EB-4 and EB-5 were current in May 2007, we cannot say whether there will be any availability in these categories before the start of the next fiscal year on Prospective adjustment filers ask whether they should continue to prepare photos and medical exam reports in anticipation of filing, perhaps as early as
