7/17/07 to 8/17/07 resumption of LPR Adjustment Filings

A 7/17/07 USCIS announcement reopened a month-long window for filing employment-based adjustment of status applications. USCIS announced that it will accept EB I-485s filed by applicants whose priority dates are current under the July 2007 Visa Bulletin. USCIS will accept these AOS filings until August 17, 2007 and with current filing fee rates, not those increases slated to take effect on July 30, 2007. Accordingly, if you have an approved RIR or PERM labor certification and a pending, approved or in progress I-140, please contact us immediately about preparing your Adjustment of Status application for filing before August 17, 2007. No news yet on CIS progress/process on adjudication of its backlog of 60,000 pending AOS applications; on receipting of AOS applications received since July 1, 2007; or on readoption of premium processing of I-140's in August; whether self-filed I-140 petitions may be filed in August, or the status of IV consular processing in August. Please read our newsletter for further updates. First, to begin the adjustment applications, we will first need a long list of items from you. Please see our online adjustment of status memo for more in-depth information on the adjustment of status process. Below are links to many of the items that you will need to complete and return to Miller Mayer when you are ready to file for adjustment of status. Each person adjusting will need to provide the following: 1) Completed adjustment questionnaire. This should be completed first and should be returned to our office immediately if you intend to adjust your status in July; 2) Complete copies of passport, visa and most recent I-94 card; 3) Copy of birth documentation with English translation; 4) Copy of marriage documentation with English translation and prior marriage and divorce/death documentation (if applicable); 5) Medical exam, Form I-693 and vaccine supplement. Please see the memo describing how to locate the CIS authorized physician nearest to your home address. You should make an appointment soon as this is the most time consuming part of the process; 6) Recent letter of employment; 7) Copy of driver's license; 8) Copy of social security card; 9) Six photos; See the photo specifications for further instruction on having your photos taken.
